These Terms of Service ("Terms") govern access to and use of LotCast, a product of Datatik LLC ("Datatik", "we", "us"), available at lotcast.ai and api.lotcast.ai (together, the "Service"). By enrolling a dealership, accessing the API, or otherwise using the Service, you agree to these Terms. If you're agreeing on behalf of a dealership or company, you're confirming you have authority to do so.
LotCast is a neutral inventory discovery and lead-submission platform. Dealers enroll their vehicle inventory (automotive or powersports) with LotCast; AI agents and assistants (such as Claude or ChatGPT, connecting via the Model Context Protocol) can then search that inventory and submit buyer leads to the relevant dealer on a customer's behalf. LotCast does not itself sell vehicles, employ salespeople, or act as a dealer.
Datatik LLC is registered and operates in the United States, and the Service is currently offered only to dealerships and businesses located in the United States. We don't currently support dealer enrollment or service delivery outside the U.S., and we may decline or remove enrollments that don't meet this requirement.
To enroll, a dealership provides accurate business, contact, and inventory feed information. You're responsible for:
LotCast is offered in multiple tiers (Free, Base, Analytics for automotive/powersports dealers) with different feature access; current tier pricing and features are described on our pricing page or provided directly to you. We may change tier features or pricing with reasonable notice.
We may suspend or set a dealer account to inactive status — for example, for inaccurate inventory data, non-payment, abuse of the platform, or violation of these Terms.
When a lead is submitted on a buyer's behalf, LotCast delivers it to the relevant dealer by email, in either plain text or ADF/XML format, depending on the dealer's configured preference. LotCast is a delivery mechanism, not a party to any resulting transaction — we don't guarantee lead accuracy, buyer intent, or that a sale will result, and we're not responsible for what a dealer or buyer does after a lead is delivered.
Developers and AI platforms may access LotCast's API to search inventory (inventory:read scope) and submit leads (leads:write scope), authenticated via an API key or OAuth/JWT token issued through our identity provider. By using the API, you agree to:
We may throttle, suspend, or revoke API access for any client that violates these Terms, abuses the Service, or degrades platform performance for other users.
You agree not to: probe, scan, or test the Service for vulnerabilities without authorization; attempt to bypass rate limits, authentication, or access controls; use the Service to transmit unlawful, fraudulent, or misleading content; or interfere with other dealers', buyers', or agents' use of the Service.
LotCast and its underlying software, design, and branding are owned by Datatik LLC. Dealers retain ownership of their own inventory data; by enrolling, you grant LotCast a license to display, transmit, and make that data discoverable by AI agents as part of operating the Service.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that inventory data displayed through it is always accurate or current — inventory data originates from each dealer's own feed and can be affected by sync timing, feed errors, or third-party system issues outside our control.
To the fullest extent permitted by law, Datatik LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Service — including from inaccurate inventory data, undelivered or delayed leads, or API downtime. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the 12 months before the claim arose.
You agree to indemnify and hold Datatik LLC harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your inventory data, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, for conduct that violates these Terms or that we believe harms other users, LotCast, or third parties. Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-law principles.
